I just put this up over at MCS. To save time and typing, I'll just Cut and Paste it here. I hope this eases some of the rampant fears and rumors that have been swirling around all day long.
My brother in law who lives in the northeastern US and is one of the subjects of this purported filing ;) asked me to contact an attorney, anonymously, and detail what we know so far. And that's just what I have done. I've been in contact with a close friend of mine, who was a former prosecutor for one of the largest counties in the United States for 10 years, is now in private practice, and who has defended numerous individual DTV AND Echostar lawsuits. He knows "Satlaw" backwards and forwards.
Not being a legal expert, I cannot say with authority what means are available to attorneys that the public doesn't have access to. Legal experts on these forums would know more about this than I would. I can tell you this...this attorney contacted the court directly, and also spent nearly an hour using every tool at his disposal to determine if such a case exists.
There is absolutely nothing. As of March 2, 2005, according to his findings, Echostar Communications Corporation has filed NOTHING in ANY court in reference to the defendents mentioned in this document.
There is NO such case pending in the United States District Court, Miami - according to this attorney's research. This was also verified by an actual conversation with someone at that court. The case number doesn't match any case in any court in the land. Supposedly this was filed Feb 25, in this court. Again, according to his research, this is false.
There IS a pending lawsuit against a Donald ONeil - totally unrelated to Echostar, and of course, could be one of thousands of Donald ONeil's. This isn't Magician's name in the first place. I doubt seriously if anyone in the testing community knows the true identity of the Magician, even if they've met him face to face. He's as reclusive as they get.
Take that information for what it's worth. While I suppose it's possible that any and all information pertaining to such a case could be totally sealed where NO one has access, bear this in mind...SOMEBODY came up with it. It showed up at MCS yesterday evening, didn't it? Who originated it ? MCS members are always asking about sourcecode - who's the source of this ?????
