Did our court system handle this situation correctly or not.

I believe so, damn anyone who keeps me in that condition for years . The church and the gov't have no right to dictate or judge in this kind of case; if we take her husbands interests and statements as being those of his wife then the issue is resolved.
Get your living will folks or you could end up on the receiving end of a bunch of tubes like it or not.

It's so confusing not being American to look at something like this.
How do you measure the quality of life for someone who cannot represent themselves in a manor you may be acustom to?
How do you judge a democracy that can watch someone die because they see no quality of life, yet they interfere with other countries with the justification that their quality of life is poor and try to improve their quality of life while letting their own citizens die in the process?

Sad to say but Terri has been "dead" for many years. She was "brain dead" and had no functions or life what so ever. If you cannot function without atificial means you are better off leaving this world. I agree Cimba-get your living will!! I have mine as did my wife (who died of cancer 10 years ago). And Martok, I believe that quality of anything (life included) is better then quanity anytime. Especially if it is a permanent and non reversable thing.

You are so RIGHT cimba I have to agree with you 100%. My wife and 2 sons ages 12 & 20 and My self have filled out Living wills as well. We don't want to live in that state, all 4 of us decided it was a financial burden and makes a hardship on the rest of the famy if they can't decide. We won't the plug pulled if there is NO other choice than to live like that Lady did. I think our govorment did the best thing and the rest of my family agrees as well. They should have STAYED out of the the first time Jeb bush ordered the feeding tube back . The govorment and no courts should have that right.

What the courts decided was horrible. Where else in the world can you get more time in jail for starving a animal than a human.
However the husband had the right to uphold his wife's wishes if they were hers. In the court records he did not mention that she did not want to live like that until he was awarded a million bucks 300k for him and 700k for her care. So if she is gone he gets more money.
But the court is upholding what the husband wants. I know I would not want anyone interfering with my wifes well being. I think that he should step back and let her family take care of her if they are willing.

The tragedy of this thing is the media was TOO heavily involved. It was a very personal thing for all of her family.
I recently made the decesion to have my father removed from a resperator according to his wishes. No courts, no judges, no camera. Just watching someone who was important to me being alive reaching room temprature.

She was brain dead for years.The hopital only wanted the money.When that was dried up for a long enough time ya got to pull the plug.If it was a broke person no one would be talking about this.They would of pulled the plug long ago.And if it was me!I would have wanted the plug pulled after they figured out my brain was dead!

The more I think about it the more I see you have about as much of a grasp on history as you do reality. If a so-called test detonation would have worked then why did the Japs not surrender after the first bomb was dropped. Think and quit letting your anti-American Jealousies cloud the facts of history.

They did do a "TEST" in the pacific and invited everybody to watch, including Japan.
When they refused to end the war after that they dropped the second one on them. The peoplewho lived there were 'forcably moved' off their home island (Bikini Atol) have been trying to go home for 60 years.
They dropped a second one not because they were not going to surrender but because there were two in existance and the president did not want one lying around that people would 'naturally' want to drop on Europe.
He never imagined that a few years later we would be making them by the thousand.
Feel sorry for them when you are driving tour Honda home listening to your Sony radio to watch TV on your Sanyo while your wife makes dinner in your Mitsbushi microwave. Declaring War on the U.S. is like money in the bank, Japan was broke at the start of WW2 now it's rich. Thanks to U.S. Dollars, what's a few dead people compared to business prosperity.

WASHINGTON - Supreme Court Justices Anthony Kennedy and Clarence Thomas on Tuesday defended the independence of federal judges and suggested that criticism such as that directed at the federal bench recently by Republican leaders in Congress is simply part of the democratic process.
The justices' comments came during a congressional hearing on the Supreme Court's budget that turned into an unusually wide-ranging discussion of the role of judges. Thomas noted that federal judges are appointed for life, which means that although they might be criticized by politicians, the judges are insulated from real retribution.
"I think the reason we have lifetime appointments is that we are supposed to be criticized," Thomas said.
The justices' two-hour appearance before a House Appropriations subcommittee gave them a chance to respond generally to a series of complaints about the federal bench. Such complaints have escalated recently as some Republicans in Congress have blasted federal judges for not intervening in the case of Terri Schiavo, the brain-damaged woman in Florida who died March 31 after a state judge ordered her feeding tube removed.
"The time will come for the men responsible for this to answer for their behavior," said House Majority Leader Tom DeLay, R-Texas, who referred to a "judiciary run amok." Sen. John Cornyn, R-Texas, has criticized judges who make "political decisions yet are unaccountable to the public."
DeLay was a leading supporter of unusual legislation that Congress passed to allow Schiavo's parents to make a final appeal to a federal court to try to stop Schiavo's husband, Michael, from having the feeding tube removed. Federal courts, including the Supreme Court, declined to intervene.
Kennedy said criticism of the federal bench is part of "the democratic dialogue," and he dismissed a suggestion by Rep. Todd Tiahrt, R-Kan., that the Supreme Court should be concerned about public dissatisfaction with its decisions. Kennedy noted that the most controversial rulings begin with dissent among the justices themselves.
Kennedy and Thomas also emphasized the need for more security at the high court, in part to protect against threats to the nine justices and others in the court's marble building
The court's proposed budget of $66 million for next year includes money to add 11 police officers to the court's current squad of about 130. One new officer would assess threats made against the justices.
Thomas said he believes the Internet has helped critics of various rulings incite anger at the justices. Explaining why he thinks that the court needs more police officers, Thomas said, "I think we have been on borrowed time for a long time."
Separately, the Judicial Conference of the United States, which handles budget requests for lower federal courts, asked Congress for $12 million to install home-security systems for the more than 800 federal judges. The request follows the slayings of the husband and mother of federal judge Joan Humphrey Lefkow of Chicago.
Kennedy said it had not been determined whether the home-security request would cover Supreme Court justices.
Tuesday's session was marked by a collegiality that contrasted with the recent rhetoric by DeLay and Cornyn. Rep. Ed Pastor, D-Ariz., said he disagrees with many high court rulings, but he said he respects the justices' independence.
Tiahrt, the only panel member who criticized rulings by the high court, said he was concerned that the court has cited international law in rulings. "Lately we've had rulings that seem to go beyond the rule of law," he said, referring particularly to a decision last month that struck down the death penalty for those who committed their crimes as juveniles.
Kennedy wrote the court's opinion in that case, a decision in which he noted that the USA was virtually alone in the world in allowing executions of juvenile offenders. As Tiahrt spoke Tuesday, Kennedy showed no emotion, and he did not respond directly to Tiahrt's criticism. Kennedy did, however, note the court's history of dealing with controversial issues.

I think most people would agree that the poor girl shoul be given a mercy full death, not allowed to waste away, we give animals better deaths than that.
Mercy Killing is not wrong after a certain point neither is suicide or assisted sucicide.
I do not agree with doing away with the death penality for juvies who deserve it any more than the states that do it.
What people forget is that the laws are so lax here, coupled with the totalitarian drug laws that we have a larger percentage of people in prisons that russia ever had.
Most should have been imprisoned or executed at a early age and have been in and out of prison since they were kids for crimes ranging from petty theft to murder but were re-hab-il-a-tated in 6 months or a year and let go on parole.
(or released from a juvie murder charge when they turned 18)
The only way to stop REAL crime is to empty the prisons of druggies and DWI people stop making them country clubs and put REAL criminals there for a long, long, time.

Empty the prisons of people that really do not need to be there, with a warning that they will have a PERMANANT vacation if they fuck up again. And put the really bad cases away forever.

They need to use the 3 strike law more often, they used it on my brother in law and gave him 40 yrs for robbery. The stupid crack head some how got a job at a pizza joint (Papa Johns) as ASSISTANT Manager and had already been in jail several times and prison one other time for stealing and purse snatching. He left one night with the night deposit and was found a couple days later and was charged with robbery and was wanted again for purse snatching in Fla and was living outside new orleans so they gave him 2yrs and did not take him to fla for the purse snatching since new orleans had him . then the idiot got out and robbed a Cracker Barrel had his hand in his coat pocket like he had a gun that time they poped him with the 3 strike law 40yrs and he was only 21he will get out sometime this year after doing 15 yrs. hopely the dummy has learned his lesson. LOL Like Forest Gump said Stupid is as stupid does. I could not belive he robbed a Cracker Barrel for crack money but this is the truth.

If you have ever had to work the scene of a wreck where the drunken bastard was walking around without a scratch on him but the mother, father, child or all of the above was killed or mutilated then you would probably agree with me. I have heard these idiots say time after time that they drive better drunk or being high don’t affect the way they drive. These people are idiots and should have the shit slapped out of them everytime they spout that absurd shit. Druggies probably commit more burglaries trying to get money for drugs than anyone does. As far as the death penalty goes it has been turned into a joke. Commit mass murder and you will spend 10 to 20 years or longer on death row with every bleeding hart Jane Fonda wannabe out there fighting to keep you alive before your number is ever called. Stiffer punishments and stricter enforcement will not immediately work but will eventually help. I find it mind boggling that our congress impeaches a president for getting his dick sucked but then tries to interfere when a women in a irreversible vegetative state with no cerebral cortex left is going to die. Their priorities leave a lot to be desired. Maybe with the 2006 elections we can replace some of these dorks and inject some new blood that understands why they are there and will finally start doing what they were elected to do.

I was a Milatary coprsman for 6 years (3 in Nam) and a Firefighter / Paramedic for 35 years till I was pensioned off for work related injuries. I saw enough.
I am not saying let out the Hard core junkies or DWI that have accidents and / or kill people.
They put kids away for longer terms than armed robbers just for getting high. And a drunk away for two or three years for tickets. That takes up prison space so they (hehehe) let the killers and rapists go to make room for them.
Lets do something else with these MINOR offenders and get the really bad ones off the streets early and permanantly.

I have never been able to get the image of the little girl or her mother we had to cut out of their car while the drunk that hit them was running his mouth saying he didn’t know what happened.
How do you differentiate between hardcore and minor? It only takes one time to kill or destroy a life. Then I will admit, my views on drunk drivers changed a whole lot that night. I don’t think any of them should be let out early. Murderers, rapist, child molesters, and such should never see the light of day.
Hard to believe that I’m a Democrat isn’t it.

It's a matter of economics, there will never be enough prisons to hold everyone that belongs and there will never be enough executions since half the condemmed die of natural causes before their appeals are finished and they are executed.
Maybe we need more demand for organs in the bank.....
Reminds me of a story I read about a man about to ge executed going to his last appeal.
The organ banks had caught on big time and they put condemmed prisoners in the bank for spare parts.
worked out so good, he was on the list......for his third speeding ticket.

Firing squad and a reformed appeals process would solve the overcrowding problem. With today’s DNA technology we could have less chance of an innocent person be put to death than ever before in history. If the case is clear cut shorten the appeals process by 10years and save hundreds of millions of $$ if not more each year. Not to mention the fact that you will die for committing capital murder seems a pretty good deterrent to me.
To change the subject for a second, why do we want to stop these gang members or Mafia families and other such criminals from killing and eradicating each other? Let help them confine it to themselves and support it. Hell, we can put them all together on a big open lot and see who wins. Think of the revenue from the PPV.

The sheriff siad let om kill each other they are far enough from town they can't hurt anyone else. so he put a perimeter around the property and a big sign at the only entrance and exit.

Made a deal with all concerned that paramedics were untouchable or they would have to bring everyone out for medical attention. So the only ones allowed inside were party goers and paramedics.
Collected all the weapons and prints ON THE WAY OUT (for evidence).
6 dead, 41 inured, 30 overdoses, 2 new babies, 4 heart attacks.
50 arrested all deaths ether ruled natural, accidental or someone was convicted.
They said it was the best party they ever had, no hassels from the cops.
Cops said the same thing, No damages or innocents bothered, no Cops or Cop cars hurt, all cases solved.

Yep. they actually prosecute some of them, mostly so they rat on others and usually the hit men since they have the best info, then they move them somewhere no one heard of with a new name and no one gets hit till they find a new hit man.

I just saw where a DRUNK turned in front of 2 bikers here in Charlotte and one of thr bikers is DEAD the other serious condition, so far the DRUNK DRIVER has only been charged wit DUI I hope the hell he is charged with deat by auto.
