The legacy atmega256 is Lexus' version of the atmega256. It is not USB programable. The atmega128 is so named because it has an atmega128 chip as it's main processor. I'm not sure what chip is on either version of the atmega256's. With the USB atmega256 the chip id is scraped off. I'm sure somebody knows what chip is on them though.

The processor is indeed an atmega256 chip but the USB Atmega 256 also has a USB chip and a dedicated crypto processor that holds more RAM and aids in the calculations.
